Cannabis legalization in Montana
Montana voted to legalize adult-use cannabis during the 2020 General Election and legalization in the state took effect on January 1, 2021. The state passed legislation to implement regulated cannabis sales in May 2021 and sales are expected to start January 1, 2022. Until then, the only legal way to access cannabis outside of the medical cannabis program is by growing it yourself (or receiving it from a friend).
Montana medical cannabis industry
Montana voters approved medical cannabis in 2004 but the conservative Legislature later crippled the industry by limiting providers to servicing just three patients, each. Voters ultimately overturned those restrictions via a ballot initiative in 2016.
Cannabis possession & cultivation rules
- Montana adults aged 21+ are allowed to possess up to an ounce of cannabis.
- Adults in Montana can also grow up to four cannabis plants at home.
